Noting that former Chief Justice of India DY Chandrachud has overstayed in the Chief Justice's official residence, the Supreme Court administration has written to the Centre, urging it to ensure that the bungalow is vacated and returned to the court's housing pool.

Justice DY Chandrachud, who held office as the 50th Chief Justice of India from November 2022 to November 2024, continues to stay in the Type VIII bungalow nearly eight months after his retirement, according to reports. His successors, Justices Sanjiv Khanna and the incumbent CJI Bhushan R Gavai, have both declined to shift into the official residence, choosing to remain in their previously allotted accommodations.

In its July 1 letter, the Supreme Court administration has urged the Ministry of Housing and Urban Affairs to get the bungalow vacated immediately. "I am to request you to take the possession of Bungalow No. 5, Krishna Menon Marg, from Hon'ble Dr. Justice DY Chandrachud without any further delay as not only the permission that was granted for retention... has expired on 31st May, 2025, but also the period of six months provided in Rule 3B of the 2022 Rules has expired on 10th May, 2025," says the letter from a Supreme Court official to ministry's secretary.

Justice Chandrachud reacts

When contacted, Justice Chandrachud said that Justice Sanjiv Khanna had allowed him an extension until April, and at the end of April, he wrote to Justice Khanna requesting a further extension until June.

“We were looking for a specific house since our daughters have special needs. We have created an ICU-like setup for our elder daughter, and hence, finding a house in the open market according to our needs is difficult. So I had requested the government to give me a temporary accommodation on rent," he said. He further said the government house allotted to him required significant repairs, and that he is waiting for the work to be completed, after which the transfer process can begin.

Rule 3B of the 2022 Rules allows a retired Chief Justice to retain Type VII accommodation—one category below the Type VIII residence at Krishna Menon Marg—for up to six months after demitting office.
